====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-02-2022 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 306/34 of the Indian Penal Code.

The prosecution case as per F.I.R is that due to mental and physical torture by these petitioners, the victim committed suicide.

It is submitted by learned counsel for the petitioners that victim was the own brother of the petitioner No. 1 whereas petitioner No. 2 is wife of petitioner No. 1 and since the petitioner No. 1 was some property dispute with the informant

Patna High Court CR. MISC. No.18389 of 2021(5) dt.22-02-2022 2/2 who happens to be the cousin brother of the petitioner No. 1, the petitioners have been implicated falsely in this case. In fact, the victim met with an accident due to which he died. In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Muzaffarpur in connection with Sakra P.S. Case No. 216 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
