The petitioner, namely, Anjay Mehta @ Ajay Mehta @ Ajay Mahto is in custody since 23.07.2014 in connection with S.Tr. No.228 of 2014(arising out of Narayanpur P.S. Case No.5 of 2009) under Sections 302/34 of the I.P.C. and Section 27 of the Arms Act.

The learned counsel for the petitioner submitted that almost all the co-accused persons, including the co-accused persons whose cases were on same footing as that of this petitioner, have already been granted bail by this Court in Cr. Misc. Nos.34274 of 2011, 21059 of 2011, 10993 of 2010, 8208 of 2010 and 7626 of 2010.

Patna High Court Cr.Misc. No.48538 of 2014 (2) dt.20-02-2015 The learned counsel further submitted that even the assailant i.e. Satish Yadav has also been granted bail by this Court in Cr. Misc. No.21059 of 2011.

Considering the above facts and circumstances of the case, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.10,000(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, Bhojpur in connection with S.Tr. No.228 of 2014(arising out of Narayanpur P.S. Case No.5 of 2009).
