JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 This is an application for grant of anticipatory bail in connection with Mejorgunj P.S. Case No. 463 of 2018, disclosing offences under Sections 272/273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act,2016.

Allegation is of recovery of 1863 liters of liquor from a Bolero vehicle and two persons succeeded in fleeing away and the F.I.R further shows that prior to that the police has received information of carrying of liquor by one co-accused Keshav Jha and the petitioner is also accompanying Keshav Jha. Submission of learned counsel for the petitioner is that there is no source of information mentioned in the F.I.R or in a case diary as to how the petitioner has been named in the

Patna High Court CR. MISC. No.9387 of 2019(3) dt.24-04-2019 2/2 F.I.R. and the petitioner has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand ) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Sitamarhi Cum Special Judge Excise Act, Sitamarhi in connection with Mejorgunj P.S. Case No. 463 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
