2. The petitioner apprehends his arrest in a case registered for offence under Sections 406, 409, 420 of the Indian Penal Code.
3. As per written report of Mukhiya and Panchayat Secretary of Selhori-Belhori Panchayat, under a government scheme, petitioner was paid total Rs. 3,57,500/- for supply of dustbin, cart, e-Ricksha etc., however; no material was supplied by the petitioner, despite notice was sent to him.
4. Learned counsel for the petitioner submits that petitioner has been made accused in this case, since he refused to pay 50% commission to informant from this project. Petitioner has already supplied materials worth Rs. 3,79,873/- through his company namely Samman Infrastructure & Service

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that petitioner is named in the F.I.R. with specific accusation that he embezzled the government money. There is no material to show that this petitioner supplied aforesaid items to the Gram Panchayat.
6. Considering the nature of accusation, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
