Learned APP has submitted that today, Investigating Officer, Rama Shankar Prasad has been produced before the learned lower court and has been examined. That means to say, all the witnesses have already been examined.
That being so, the show-cause is accepted and the physical presence of the Superintendent of Police, Madhepura is dispensed with.
Heard learned counsel for the petitioner as well as learned APP for the State.
Petitioner is the husband of the deceased. It has been submitted on behalf of the petitioner that witnesses have turned hostile and on account thereof, no evidence remains against the
Patna High Court Cr.Misc. No.50701 of 2015 (4) dt.03-02-2016 petitioner. That is the matter of trial which could be properly appreciated by the learned lower court. Accordingly, prayer for bail is rejected.
In case, there happens to be active co-operation at the end of petitioner, then in that event, the learned lower court will proceed with the trial on day-to-day basis and conclude the same within two months positively.
