JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking anticipatory bail in connection with Daraunda P.S. Case No. 243 of 2019 registered under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, Siwan.
Learned counsel for the petitioner submits that both the parties are own gotias and on account of land dispute they had entered into a scuffle. There is case and counter case between the parties in which allegations have been made by both the sides of assault causing to each other. Learned counsel submits that petitioner has got no

Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail of the petitioner. Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that both the parties are own gotias and on account of land dispute they perhaps had entered into a scuffle, there is case and counter case in which allegations have been made by both the sides of causing assault to each other but finding that there is an allegation against this petitioner that he had assaulted the informant on his head by iron rod and one of the injuries found is grievous in nature, I am not inclined to grant privilege of anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is, thus, refused.
In case, the petitioner surrenders and prays for regular bail in the court below, the same will be considered on it's own merit keeping in view the submissions recorded hereinabove as also the materials which may come on the record without being prejudiced by the orders of this court
Patna High Court CR. MISC. No.7394 of 2020(2) dt.28-02-2020 3/3 and the prayer for regular bail shall not be refused only because this court has not entertained the prayer for anticipatory bail of the petitioner.
