The petitioner seeks bail in Fatwah P.S. Case No. 38 of 2014, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

The informant alleged that the petitioner and others were constructing on the land of the informant on such her fatherin-law objected. It is alleged that the petitioner Brijay Yadav @ Brije Yaav, Badan Singh and Ramayan Yadav assaulted Suresh Yadav and tried to throttle his neck.

Learned counsel for the petitioner submits that no external or internal injury was found. The doctor who held the post-mortem did not give any finding with regard to cause of death and viscera was reserved.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City in connection with Fatwah P.S. Case No. 38 of 2014.
