Petitioner apprehends arrest in a case registered for the offence punishable under sections 325, 341, 307, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act. As per FIR, three named and three unknown persons are alleged to have shot dead the deceased.

Learned counsel for the petitioner submits that name of the petitioner transpired during the course of investigation and by the confessional statement of co-accused Mukesh Kumar. There is no cogent or valid material present on the record to connect the petitioner with the offence. Learned counsel for the State opposes the bail petition

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional chief Judicial Magistrate, 4th Gaya in connection with MMCH P.S. case no 237 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
