Admittedly, petitioner is husband of the informant and petitioner was granted provisional bail by this court vide order dated 12.12.2013 and notice was issued to the informant to procure her attendance before this court but the informant refused to sign the notice and also did not appear.

From perusal of the impugned order, it is obvious that the informant is residing at her matrimonial home. Considering the aforesaid facts and circumstances as well as submissions of the parties, provisional bail granted to the petitioner by this court vide order dated 12.12.2013 in connection with Belaganj P.S. Case no. 282/2012 pending in the court of the Chief Judicial Magistrate, Gaya is, hereby, confirmed.

Accordingly, this petition stands disposed of. shahid (Hemant Kumar Srivastava,J) U T
