The petitioner is in custody in a case registered under Section 302/34 of the Indian Penal Code.
It is alleged by the informant that on 8.4.2015 her husband Umesh Ram went to the brick kiln for working and did not return till evening and thereafter she searched her husband but he was not found and on the next day i.e. on 9.4.2015 she got information that the dead body of her husband was found in the area of Brahm Baba and she claimed that her husband has been killed by this petitioner and other accused persons by pressing his neck.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.35914 of 2015 (3) dt.06-10-2015 2/2 petitioner has got no criminal antecedent. The petitioner is in custody since 19.04.2015.Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner and merely on the basis of suspicion, the petitioner has been made accused in this case. It is further submitted that other co-accused has been granted bail vide order dated 18.09.2015 in Cr. Misc. No. 43377 of 2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Saran at Chapra in Marhowrah P.S.Case No. 93 of 2015.
