JUSTICE SHIVAJI PANDEY ORAL ORDER 03-11-2015 Heard learned counsel for the petitioners and learned counsel for the State.

In these cases, petitioners are seeking bail in connection with Dandkhora P.S. Case No. 51 of 2015 registered for offence u/s 354 (A) of the Indian Penal Code and Section 11 of the Protection of Children from Sexual Offences Act, 2012.

Patna High Court Cr.Misc. No.48320 of 2015 (2) dt.03-11-2015 2/2 Allegation has been made against these petitioners that they have followed the school going girls on motor cycle and when they have found a deserted place, they started teasing them. On raising alarm, three persons i.e. these petitioners and one of their friend were caught and arrested by the Police. As has been submitted that petitioners are the students of Intermediate and are in jail since 15th August 2015. Looking to the nature of allegation and circumstances of the case, the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge-I, Katihar in connection with G.R. No. 2283 of 2015 arising from Dandkhora P.S. Case No. 51 of 2015, subject to the condition that (i) one of the bailors shall be father of the petitioners and (ii) if the petitioner is found involved in future in similar type of case, the prosecution will have liberty to file an application for cancellation of their bail.
