JUSTICE SUDHIR SINGH ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 07.05.2015 in connection with S.T. No. 784/2010, arising out of Sarmera P.S. Case No. 34 of 2002 for the offences instituted under Sections 302, 201/34 and 120(B) of the IPC.
The prosecution case, in brief, is that while the informant had gone to North of Manachak Village to bring Trailer of the Tractor through a Boat and when the said Trailer was loaded on the Boat and was coming back, the petitioner alongwith other coaccused started firing due to which the brother of the informant, namely, Ram Balak Dharhi, sustained fire arm injuries, and then the informant jumped down from the Boat and started fleeing away and in the meantime, he saw that Bhasho Kewat was caught
Patna High Court Cr.Misc. No.36207 of 2015 (3) dt.06-10-2015 2/2 by the accused persons and Ram Balak Dhari was being pulled along the ground and Bhaso Kewat was shot at and he was also being pulled along the ground and was taken towards Hariyari. Due to previous enmity, they have murdered the deceased and dead bodies have been concealed some where in the water. It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.05.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. There is general and omnibus allegation against the petitioner. Other co-accused have been granted bail by this Court vide Cr. Misc. Nos. 18165/2011, 50575/2008 and 18165/2011.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IV, Nalanda at Biharshariff in connection with S.T. No. 784/2010, arising out of Sarmera P.S. Case No. 34/2002.
