JUSTICE AMARESH KUMAR LAL ORAL ORDER 30-01-2015 Both the cases arise out of Bagaha P.S. Case No.89/2014, as such, they have been heard together and are being disposed of by this common order.
Heard the learned counsel for the petitioners and the State.
The petitioners are in custody in a case registered for the offence punishable under Sections 341, 323, 325, 302 and 504/34
Patna High Court Cr.Misc. No.45466 of 2014 (2) dt.30-01-2015 2/3 of the Indian Penal Code.
The allegation against the petitioners and four others is to have assaulted the husband of the informant which resulted into his death.
It is submitted that the deceased was met with an accident which caused his death. The only two injuries have been found on the person of the deceased. The petitioners have no criminal antecedent.
Considering the facts and circumstances of the case, let the above-named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Bagaha, West Champaran in Sessions Trial No.512/2014 arising out of Bagaha P.S. Case No.89/2014 with the following conditions :
1.
One of the bailors will be the close relative of the petitioners.
2.
The petitioners will not indulge in similar or in any other offence.
3.
The petitioners will be well represented in the court.
4.
In case of absence for two consecutive
Patna High Court Cr.Misc. No.45466 of 2014 (2) dt.30-01-2015 3/3 dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
