Petitioner seeks bail in Sarai P.S. Case No.160 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. Name of the petitioner has been disclosed by co-accused in the confessional statement.

It is further submitted that other co-accused have been granted bail vide Annexure-2 series.

Petitioner is in custody since 07.08.2018 having clean antecedents. From the impugned order also, it appears that name of this petitioner has come in para 63, 76, 14 of the case diary in

Patna High Court Cr.Misc. No.10177 of 2019(2) dt.20-02-2019 2/2 the confessional statement of the co-accused. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate XIII cum Sub Judge XIV, Vaishali at Hajipur, in connection with Sarai P.S. Case No.160 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
