JUSTICE SHIVAJI PANDEY ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner and the State. The petitioner is seeking bail in Chhatauni P.S.Case No. 119/2014 for the offences punishable under Sections 414/34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of Arms Act. The police party has recovered arm from the possession of one co-accused.
The petitioner is in jail custody since 05.07.2014. There is no criminal antecedent.
Looking to the period of custody, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in Chhatauni P.S.Case no. 119/2014, subject to the conditions that-
Patna High Court Cr.Misc. No.45929 of 2014 (2) dt.04-02-2015 2/2 (i) one of the bailors will be a close relative of the petitioner.
(ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary orders, including cancellation of bail bonds and (iii) that the petitioner would co-operate and if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
