Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Hussainganj P.S. Case No.45 of 2014 registered under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

The accusation is that the petitioner produced the rent receipt bearing no.685835 dated 06.12.2012 in respect of Khata No.280, Khesra No.1715 measuring an area of one Bigha, one Katha and sixteen Dhoors issued by the employee of Revenue Department, Sri Laxman Ram, and on that very basis, the petitioner got the order in his favour by the court of Sub Divisional Magistrate, Siwan. On enquiry,

Patna High Court Cr.Misc. No.56359 of 2015 (2) dt.22-12-2015 2/2 the said receipt was found forged and the same was in respect of the land over which the house of Sumitra Devi is situated. Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is care-taker of S. Yadgar Husssain, son of Late Bibi Zahera, in whose favour the rent receipt is said to have been issued. The petitioner has no concern over the said land, therefore, no question arises for the petitioner to produce the forged rent receipt. Moreover, the petitioner is in custody since 27.07.2015. The petitioner is accused in two other cases, , as detailed in paragraph-3 to the application.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Hussainganj P.S. Case No.45 of 2014. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
