JUSTICE SUDHIR SINGH ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 22.05.2015 in connection with Fatehpur P.S. Case No. 223 of 2012 for the offences instituted under Section 302/34 of the IPC. The prosecution story, in brief, is that the sister of the informant was married with one Brahamdeo Yadav who was working at factory in Raniganj who died one month ago from the alleged date and time of occurrence but the accused persons committed murder to the sister of the petitioner, namely, Manorma Devi, due to dowry in connivance of all the named accused persons.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.36438 of 2015 (3) dt.06-10-2015 2/2 petitioner is in custody since 22.05.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. The petitioner is the father-in-law of the deceased. The deceased was widow and she was not keeping well and due to illness she had died. The present case has been instituted for oblique reason. There is no eye witness to the occurrence. Merely on the basis of suspicion, the present case has been instituted. The petitioner is aged 70 years. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, in connection with Fatehpur P.S.
