04-03-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Maner P.S. Case No. 287 of 2010 dated 07.11.2010 instituted under Sections 147/148/149/341/323/337/307 of the Indian Penal Code and lateron 302 of the Indian Penal Code was also added. Learned counsel for the petitioner submits that as per the allegation a mob of 200 persons had killed the deceased and the petitioner is among nine persons who have been identified in the crowd as being member of the mob. Learned counsel submits that out of the nine named persons Rakesh Manjhi, Rudal Manjhi and Shivdhar Manjhi have been granted bail by co-ordinate Benches of this Court in Cr. Misc. No. 13953 of 2011 on 06.09.2011, Cr. Misc. No. 13796 of 2011 on 06.09.2011 and Cr. Misc. No. 147 of 2015 on 07.01.2015 respectively. It is further submitted that the petitioner having

Patna High Court Cr.Misc. No.47350 of 2014 (2) dt.04-03-2014 2/2 clean antecedent is in custody since 14.03.2014. Learned A.P.P. opposes the prayer for bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Danapur, Patna in Maner P.S. Case No. 287 of 2010. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to cooperate or appear on two consecutive dates, without sufficient cause, shall lead to cancellation of his bail bonds.
