The petitioners, (1) Akbar @ Akaber Ali (2) Saddam @ Saddam Hussain, are in custody in Charpokhari P.S. Case No.179 of 2015 instituted for the offence under Sections 302, 328, 201/34 of the Indian Penal Code.
According to the prosecution case, the dead body of the informant's son was found in the filed of one Sachiddanand Singh. The informant suspected that these petitioners and other coaccused person who are also the family members might have administered voice to the informant's son and killed him. It appears that case diary was called for. From perusal of
Patna High Court Cr.Misc. No.50538 of 2015 (3) dt.30-01-2016 2/2 the case diary, it appears that there is direct evidence. Therefore, the prosecution case is only on suspicion.
Accordingly, I direct that both the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S.Cse No.179 of (Mungeshwar Sahoo, J) Sanjeev/- U T
