Petitioner is aggrieved by the order contained in Memo No. 318/Aa dated 28.01.2014 (Annexure-4) whereby a direction has been issued by the respondents for recovery of excess amount from him for the period from 19.08.2004 to October, 2008.

Learned counsel for the petitioner places reliance upon a decision of the Apex Court in the case of State of Punjab Vs. Rafiq Mashi (White Washer) [(2015) 4 SCC 334].

Patna High Court CWJC No.18909 of 2017(2) dt.20-02-2020 2/2 In view of the decision of the Apex Court, the writ petition is disposed of with a direction to the respondents to take a fresh decision with regard to liability of the petitioner in the light of the decision of the Apex Court in the case of State of Punjab Vs. Rqfiq Mashi (White Washer) [(2015) 4 SCC 334] within a maximum period of four months from the date of receipt/production of a copy of this order.
