1. Heard learned counsel for the parties.
2. The petitioner in this application prays for bail apprehending his arrest in connection with Patliputra P.S. Case no.469 of 2024 registered for the offence punishable under sections 304(2), 62 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the informant states that two accused persons snatched his mobile and made an attempt to escape. While one of them escaped, one co-accused namely Piyush Kumar was arrested and the informant's mobile was recovered from his possession. It is further stated that the accused who has caught disclosed the name of the person who had managed to escape as being the petitioner herein.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.10523 of 2025(2) dt.22-03-2025 2/2 from the allegations in the FIR itself, it would be evident that neither the petitioner has been arrested at the spot nor any incriminating article recovered from his possession. The only material against him is the statement of a co-accused made before police. The petitioner has no criminal antecedent.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations against the petitioner in the FIR, no incriminating article having been recovered from the petitioner's possession and the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Patliputra P.S. Case no.469 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. X, Patna.
