Perused the impugned order and also perused the amendment application filed by the plaintiff, which is Annexure 2 to this civil miscellaneous application.
At the time of hearing of this civil miscellaneous application, learned counsel for the petitioner submitted that he is not pressing for amendment of para 9 (K) in the plaint. On the other hand, learned counsel for the respondents is not objecting for amendment of other part of amendment application i.e. for amendment of para 9 ( kha ) and 13 ( Kha).
In view of the above facts and circumstances of the case this civil miscellaneous application is allowed only to the effect that the amendment application filed by plaintiff is allowed,
Patna High Court C.Misc. No.1089 of 2016 (2) dt.17-11-2016 2/2 except para 9 (K) mentioned in para 1 of the amendment application.
Accordingly, the impugned order passed by the learned Sub Judge (Senior Division), Hajipur at Vaishali in Title Suit No. 392 of 2007 is modified to the extent as indicated above. Thus, this civil miscellaneous application is disposed of.
