The petitioner seeks bail in connection with Turkaulia (Banjariya) P.S.Case No. 566/2015 registered for the offences under sections 341, 323, 504, 509, 354, 448, 363, 511 of the I. P. C.
Allegedly, the petitioner used to tease the sister of the informant when she used to go to her college and further the petitioner and other co-accused after assaulting the family members, tired to kidnap the sister of the informant but due to alarm being raised, the petitioner was caught and assaulted by the villagers.
Submission is of false implication due to old grudge and previous enmity. There is case and counter case. As a matter of fact, the prosecution party brutally assaulted the petitioner at his Ice-cream Factory for which
Patna High Court Cr.Misc. No.48901 of 2015 (3) dt.04-12-2015 2/2 Turkaulia P. S. Case No. 567/2015 has been lodged by Bhabhi, Smt. Lalsa Devi of the petitioner. The petitioner is suffering in custody since 29.07.2015, having no criminal antecedent. Learned A.P.P. opposes the prayer of bail and submits that it is a case of attempt of kidnapping.
In the facts and circumstances stated above, the petitioner, Chandan Parit @ Chandan Pandit, is directed to be released on bail on execution of bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkaulia (Banjariya) P.S.Case No. 566 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
