2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 498(A), 363 and 34 of the Indian Penal Code and under Section 3⁄4 of the Dowry Prohibition Act.
3. It has been submitted that a compromise has been arrived at between the parties and the petitioner and the O.P. No. 2 are staying together at Delhi as husband and wife and leading a peaceful conjugal life.
4. Since, they have both undergone an operation
Patna High Court CR. MISC. No.10817 of 2024(11) dt.23-06-2025 2/3 they were not in a position to personally appear today, however, their parents are appearing. There is no denial of the fact even on behalf of the O.P. No. 2, that the O.P. No. 2 is staying along with the husband. The only grievance that has been raised is that the minor child of the petitioner and the O.P. No. 2 is staying with the father of the petitioner at Munger. The father of the petitioner has also appeared today and he undertakes that once the petitioner and O.P. No. 2 would recover from their ailment, the child would be sent to his parents which would be done within a period of two months.
5. In view of the aforesaid facts and circumstances of the case, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Chowk
