In this case, the petitioner is seeking bail in connection with Chhatauni P.S. Case No. 194 of 2015 registered for offences under sections 414, 273, 465, 468, 420 and 486 of the Indian Penal Code.

The Police on secret information, intercepted the vehicle and from there found loaded different brands of chewing tobacco.

The counsel for the petitioner submits that the material which has been seized, has not been banned by the State or the Central Government and the same is not a Pan Masala or Gutka which is apparently clear from the seizure list, so much so,

Patna High Court Cr.Misc. No.48549 of 2015 (2) dt.03-11-2015 2/2 the petitioner is a delivery boy, having no any ownership over the aforesaid material and is in jail since 3rd September 2015. Looking to the facts and circumstances of the case, let the petitioner, above, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Chhatauni P.S. Case No. 194 of 2015.
