2. This application, for grant of anticipatory bail, arises out of Biraul P.S. Case No. 549 of 2023 for the offences punishable under Sections 302 and 34 of the I.P.C.
3. As per the prosecution case, the informant has alleged that her son used to work under Amarjeet Mandal and he did not give a single penny for the last three years he had worked. It is further alleged that on 08.11.2023, the informant was informed by the petitioner on phone call that her son has taken some medicine and he is admitted in the clinic of Dr. Santosh Baheri. Subsequently, it is alleged that her son was called by the co-accused Soni Alam @ Md. Mursid Ali on the previous night, however, he returned home. It is next submitted that at around 10:00 P:M, his son received a phone call, then he

No.10552 of 2025(5) dt.20-08-2025 2/3 went outside and thereafter he did not return and in the morning the informant got a news that her son was found hanging with a turban and a suspicion was raised by the informant that all the named accused persons including the petitioner had conspired to kill her son.
4. Learned counsel for the petitioner submits that the petitioner is innocent and barring suspicion there is nothing against the petitioner. It is further submitted that the petitioner has been made accused in this case merely on the basis of being a person who informed the informant on her phone call that her son consumed some poisonous substance. During the course of investigation, the witnesses has stated that there was some family dispute in the house of the deceased and due to which he tried to commit suicide earlier also and, subsequently, he has succeeded in committing suicide on the date of occurrence. It is next submitted that the co-accused Soni Alam has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 20.06.2025 passed in Cr. Misc. No. 19829 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner and has stated that the police has submitted charge sheet against arrested

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that the petitioner has been made accused in this case merely on the basis of suspicion and also considering the fact that the coaccused person has already been granted anticipatory bail by a co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
7. This application is, accordingly, allowed.
8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Biraul, Darbhanga, in connection with Biraul P.S. Case No. 549 of 2023, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
