1. Heard learned counsel appearing on behalf of the parties.

2. The present bail petition preferred by the petitioner on second occasion, after rejecting his earlier prayer of bail through Cr. Misc. No. 31951 of 2023 dated 22.06.2023, after considering the available merits.

3. The petitioner is facing the specific allegation as to inflict fatal knife injury to the brother of the informant.

4. It is submitted by learned counsel Mr.

No.17367 of 2024(6) dt.09-08-2024 2/3 Awadhesh Kumar Mishra appearing on behalf of the petitioner that the case of petitioner is not different qua those co-accused persons, who have been granted bail for the simple reason that they also actively participated in the occurrence and without their participation, it was not possible for the petitioner to commit murder of the brother of informant, however, it is concealed by learned counsel that trial almost concluded and this case is pending for argument before the learned trial court.

5. Heard learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant.

6. Considering the submission and perusal of learned trial court's report dated 15.07.2024 as available through letter no. 285 that this matter is listed for 29.07.2024 for defence evidence, suggesting that trial is at its fag end. Accordingly, the prayer for bail of petitioner is rejected herewith on second consideration also.

7. However, the learned trial court is directed to conclude the trial preferably within three months of this order, subject to cooperation of accused persons/petitioner.

8. S.P. Nawada is directed to ensure the presence of concerned I.O. and doctor (remaining prosecution witnesses), positively, within aforesaid time period as to conclude the trial.
