The petitioner seeks bail in connection with Parihar P.S. Case No.55 of 2015 registered under Section 395 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the F.I.R. was lodged against unknown. During investigation, the name of the petitioner and Ravindra Rai alias Ravindra Yadav came in the confessional statement of the coaccused Chandan Kumar on whose confessional statement the looted motorcycle was alleged to be recovered. Except the confessional statement of the co-accused Chanan Kumar, there is

Patna High Court Cr.Misc. No.48389 of 2015 (2) dt.09-11-2015 2/2 nothing to connect the petitioner in the commission of the alleged offence. It is further submitted that while the petitioner has been made accused in two other cases, as detailed in paragraph-3 to this application, but in those cases, the petitioner is on bail. Similarly situated co-accused Ravindra Rai alias Ravindra Yadav has already been granted bail by a coordinate Bench of this Court vide order dated 18.08.2015 passed in Criminal Misc. No.31435 of 2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Parihar P.S.
