JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-01-2015 Petitioners are languishing in custody since 30.05.2014, 06.06.2014 in a case registered for the offences punishable under Sections 364, 34 of the I.P.C. It is alleged that uncle of the informant went outside to bring newspapers and thereafter he went missing. The name of the petitioners sprang up on confession of coaccused and on the information supplied by the secret agent.

Patna High Court Cr.Misc. No.41372 of 2014 (3) dt.23-01-2015 2/2 It is submitted by learned counsel for the petitioners that victim in his 164 Cr.P.C statement has not named the petitioners and only on suspicion the accusation has been levelled.

The statements have been made in para 3 of both the petitions that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Madhubani in connection with Ladaniya P.S. Case No. 30 of 2014, Sessions Trial No. 302 of 2014.
