The petitioner seeks bail in a case registered under Sections-341, 323, 326, 307, 34 of the Indian Penal Code and Section-27 of the Arms Act.

The prosecution case, in short, is that in the backdrop of a scuffle, one Vinod Yadav is alleged to have fired upon the informant.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 17-11-2018. Charge sheet in this case has already been submitted. There is no allegation of assault alleged against the petitioner. The petitioner has been falsely implicated in the present case. There

Patna High Court CR. MISC. No.8518 of 2019(3) dt.11-04-2019 2/2 is no allegation of assault against the petitioner. The main allgation is against co-accused namely Vinod Yadav who is alleged to have fired upon the informant and assaulted with but of pistol upon the head of one Chanarik Yadav. There is case and counter case between the parties where free fight is alleged to have taken place.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 477 of 2018.
