Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Section 379 of the Indian Penal Code, registered in connection with Kudni P.S.Case No. 447 of 2021. As per allegation, Splendor motor-cycle of the informant parked in her veranda was stolen away by some unknown thieves.

The learned counsel for the petitioner has submitted that the petitioner is person of clean antecedent. Nothing was recovered from his possession. The said motor-cycle was recovered from the workshop of co-accused Chandan Kumar.

No.9236 of 2022(2) dt.08-09-2022 2/2 There is nothing against the petitioner, except the confessional statement of co-accused Rikky Ranjan @ Rikky Kumar and on similar footing co-accused Niraj Sahni @ Neeraj Kumar has been granted anticipatory bail in Cr.Misc. No. 61422 of 2021. Considering the above facts and circumstances, especially the clean antecedent of the petitioner, let him, abovenamed, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist Muzaffarpur in connection with Kudhni P.S.Case No. 447 of 2021/GR No. 2033 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
