Petitioners apprehend their arrest in a case registered for the offence punishable under sections 143, 341, 323, 379, 308, 447, 504, 506 of the Indian Penal Code.

It is alleged all the accused persons named in the FIR including these petitioners armed with iron rod, pistol, lathi, knife came at the house of the informant and started abusing him due to dispute of flowing of water. It is further alleged that the petitioner no.1 Govardhan Kumar assaulted the informant with iron rod causing head injury and bleeding therein. Petitioner no.2 Dhanraj Kumar had taken Rs.50,000/- cash

Patna High Court CR. MISC. No.9048 of 2023(2) dt.24-04-2023 2/2 which was kept in a box on the point of pistol. Learned counsel for the petitioners submits that the petitioners are innocent and has falsely been implicated in this case due to land dispute. It is further submitted that there is case and counter case vide Muffasil P.S. case No. 90 of 2022. Injury caused by petitioner No.1 is simple in nature. Allegation of snatching case is ornamental. Petitioner claims clean antecedent. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Muffasil (Lakho O.P.) P.S. Case No. 84 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
