The petitioner is in custody in connection with Kacchwa P.S. Case No.42 of 2014 for the offences punishable under Sections 341, 323, 324, 326, 302/34 of the Indian Penal Code. Learned counsel for the petitioner with reference to the F.I.R. submits that 13 accused including the petitioner have been charged with assault on the husband of the petitioner which has caused his death. He submits that the charges are omnibus and made in general manner with no specific overt act attributed to the petitioner.

Having heard learned counsel for the parties and considering the nature of allegation, let the petitioner namely,

Patna High Court Cr.Misc.
