The petitioner is accused in connection with Sakara P.S. Case No. 219 of 2019, registered under Sections 379 and 382 of the Indian Penal Code, pending in the court of A.C.J.M.- IV, Muzaffarpur.

Learned counsel for the petitioner submits that it would appear from the FIR that on the basis of Fradbeyan of informant, Kanhai Kumar, Sakara P.S. Case No. 219 of 2019 was instituted against unknown regarding theft of his motorcycle but in course of investigation, petitioner was apprehended with stolen motorcycle of the present case, regarding which, Sakara P.S. Case No. 737 of 2019 was lodged,

Patna High Court CR. MISC. No.10202 of 2020(2) dt.03-03-2020 2/2 in which, petitioner is on bail and thereafter, petitioner has been remanded in the present case on 04.10.2019.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.

However, petitioner would be at liberty to renew his prayer for bail after three months.
