JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor, appearing on behalf of the State. This is an application for grant of regular bail on behalf of the petitioner who is an accused in Motihari Town P.S. Case No. 294 of 2015 for the alleged offences under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was arrested in connection with Motihari Town P.S. Case N0. 365 of 2015 with a stolen motorcycle and on the basis of his alleged confessional statement in course of investigation before the police, he has been remanded in various cases including the present Motihari Town P.S. case No. 294 of 2015. He further

Patna High Court Cr.Misc. No.45975 of 2015 (2) dt.06-10-2015 submits that no recovery has been made from the petitioner's possession in connection with the present Motihari Town P.S. Case No. 294 of 2015 and there is nothing incriminating against him except his alleged confessional statement made before the Police.

In view of the submissions as above, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Motihari Town P.S. Case No. 294 of 2015.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
