JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2019 Heard the learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Muzaffarpur (Sadar) P.S. Case No. 726/2018, instituted for offences under Section(s) 420, 406 and 34 of the Indian Penal Code.

It is alleged in the written report that informant had gone to meet his father-in-law in jail where the person, namely, Vivek Kumar Gautam (petitioner) told him that he can provide finance for purchasing Hiawa vehicle. The petitioner told him to contact one Dipak Kumar on his mobile. On direction of aforesaid Dipak Kumar, informant deposited Rs. 6 lacs in the account of one Satyadeo Thakur.

Patna High Court Cr.Misc. No.8427 of 2019(2) dt.13-02-2019 2/2 Learned counsel for the petitioner has submitted that from the written report itself, it appears that petitioner is not beneficiary of the alleged transaction. He has been falsely implicated in this case.

Petitioner is in custody since 05.10.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur (Sadar) P.S. Case No. 726/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
