The petitioner seeks bail in Chowk P.S.Case No.123/18 registered under Sections 341, 323, 307, 504 of the I.P.C.

The informant has alleged in his written complaint that while her grand son was playing the petitioner Golu Kumar abused and assaulted him and then his grand son came weeping and told to the informant thereafter she asked Golu as to why he assaulted her grand son upon which the petitioner became furious, and abused and assaulted with brick causing injury on her head. On hearing hulla daughter of the informant came there and the petitioner assaulted her by brick causing injury on her ear.

It has been submitted on behalf of learned counsel for

Patna High Court CR. MISC. No.8944 of 2019(2) dt.12-03-2019 2/2 the petitioner that there was a minor scuffle arising out from dispute between the parties and nature of injury as contained in Annexure-2 is simple. The petitioner has no criminal antecedent and he is in custody since 10.08.2018.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.-II, Patna City, Patna, in Chowk P.S.Case No.123 of 2018 subject to the conditions that (i) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned. (ii) petitioner/s shall co-operate in the trial and shall be represented on each and every date fixed by the court. (iii) if the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner/s.
