2. The petitioner seeks bail in a case registered for the offence punishable under Sections 8(C), 21(6), 29 of the N.D.P.S. Act.

3. 48.950 grams of Heroine has been recovered from the place of occurrence.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that nothing has been recovered from the possession of the petitioner. He submits that the charge has been framed against the petitioner but no witness has been examined uptill now. He further submits that petitioner has one criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 07.06.2023.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case and the fact that contraband article has been recovered from the possession of the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with Mohania P.S. Case No. 372 of 2023.
