In this case, the petitioner is apprehending his arrest in connection with Complaint Case No. 86 of 2017 in which cognizance has been taken under Sections 406, 504 of the Indian Penal Code.

In the present case, an allegation has been made that the accused persons had taken Rs. 50,000/- from the Complainant as a consideration money in lieu of granting job to his wife in Anganwari but, neither the job was given nor they returned the money to the Complainant.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.8016 of 2019(2) dt.13-02-2019 2/2 already he has deposited Rs. 50,000/- in the light of the order passed in B.P. No. 1824 of 2018.

In view of the fact recorded in the order impugned, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Nawada in connection with Complaint Case No. 86 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.

However, at the time of accepting bail bonds, the court below will verify regarding payment of Rs. 50,000/- by the petitioner to the Complainant, in case of non-payment of the aforesaid amount, he will not be released.
