Mr.Rana Randhir Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-02-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Brahampur (K.B.) P.S. Case No. 231 of 2018 registered for the offence punishable under Section 379 of the Indian Penal Code. The allegation is regarding unknown miscreants having stolen Bolero vehicle of the informant and subsequently the said Bolero vehicle is said to have been recovered from elsewhere.

The learned counsel for the petitioner submits that the petitioner is accused in one excise matter and that is why he was remanded in the present case from the said case, in which he is already on bail and thereafter he has been implicated falsely although neither any recovery has been made from the house of the petitioner nor there is any material on record to

Patna High Court Cr.Misc. No.8237 of 2019(2) dt.13-02-2019 2/2 connect the petitioner with the alleged crime. Lastly, it is submitted that the petitioner is languishing in custody since 01.12.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Brahampur (K.B.) P.S. Case No. 231 of 2018.
