The petitioner is languishing in jail since 06.06.2015 in a case instituted under Sections 341, 323, 307, 448, 379 and 506/34 of the Indian Penal Code.
As per allegation, it is a case for filling soil behind the door for erecting Kutcha wall as a result of which the informant was assaulted by the accused persons and they also sustained severe injuries.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He is in custody since 06.06.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the
Patna High Court Cr.Misc. No.37327 of 2015 (3) dt.06-10-2015 petitioner. It is a case and counter case. Counter case is Annexure6 to the present application. Petitioner has falsely been implicated in the present case due to previous enmity.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Gaya in connection with Belaganj P.S.Case No.93 of 2015.
