JUSTICE KHATIM REZA ORAL ORDER 16-05-2025 Learned counsel for the petitioner seeks permission to make the necessary correction in paragraph no. 1 and prayer portion of the application, in course of the day. Permission is accorded.

2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks bail in connection with Hathiyawan P.S. Case No. 70 of 2024 dated 18.09.2024 instituted for the offence punishable under Sections 137(2) of B.N.S., 2023.

4. The prosecution case, in short is that the informant was working in Sharda Goods Carrier Pvt. Ltd. at Patna since three years. The company has a Tipper Truck bearing Registration No. BR01GH5262. On 14.09.2024, the said truck loaded with stone chips was being driven by one Sanjeet Mahto.

Patna High Court CR. MISC. No.9472 of 2025(3) dt.16-05-2025 2/3 The said truck did not reach the destination on time. On search, the vehicle was found in the district of Sheikhpura in abandoned condition and the driver was traceless.

5. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. During the course of investigation, the petitioner was arrested in another case bearing Chewara P.S. Case No. 13 of 2024, in which he confessed his involvement in the present case. It is submitted that the petitioner is the owner of truck bearing Registration No. JH02BF6897. It is submitted that there is no material against the petitioner which would connect him to the said crime. Lastly, it has been submitted that the petitioner is in custody since 19.10.2024 having one criminal case against him. Charge-sheet has been submitted in the case.

6. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

7. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount
