2. The present petition has been preferred for the grant of following relief(s):

"for direction to the respondents to pay in total to the extent of Rs. 60,00,000.00/- the compensation of land and of three storage building's part portion demolished measuring 60 Sq m at Keshra no. 158/198 and 17 Sq m from Kehsra no. 226/228 of the building of petitioner to make passage of six way lane of NH2 at Pali Road at Dehri, including demolishing charge of

Patna High Court CWJC No.19039 of 2016(2) dt.02-09-2025 2/2 three storage building, wastage of 18 windows and doors besides the value of mosaic and marble which was not added at the time of consideration of said compensation for the said land and part portion of the building of the petitioner besides enhancement of increase in rate of compensation year to year till 2014."

3. Learned State counsel with the help of counter affidavit submits that the petitioner should have move before the Arbitrator under section 3(G)(5) of the National Highway Act, 1956.

4. Be that as it may, since there is no appearance, the writ petition stands dismissed for non-prosecution. (Rajiv Roy, J) vinayak/- U
