JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-04-2023 The present writ petition has been filed seeking the following relief:- "1. That, this is an application for issuance of an appropriate writ, order or direction quashing the notice dated 03.10.2017 and 13.11.2017 issued by the Circle Officer, Kadwa in Encroachment Case No. 01 of 2015-16/3 of 2016-17, whereby the petitioners have been asked show cause as to why the Encroachment has not been removed. Further direct the respondent concerned to make proper arrangement for shelter/rehabilitation of the petitioners, who are landless persons and residing over the land in question for the last 35 years."
At the outset, the learned counsel for the respondent- state has referred to the counter affidavit filed in the present case to submit that the
Patna High Court CWJC No.19333 of 2017(2) dt.25-04-2023 3/3 Circle Officer, Kadwa, District- Katihar has already passed the final order in connection with Encroachment Case No. 01 of 2015-16/ 01 of 201718 and the encroachment in question has also been removed.
At this juncture, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the respondent authorities for redressal of their grievances including filing of an appeal against the final order passed by the Circle Officer, Kadwa, District- Katihar. Liberty so sought is granted.
The writ petition stands disposed off.
