JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 6.11.2017 passed in Cr.Misc.No.43699 of 2017 and the allegation against the several co-accused, including the petitioner is that they fired at the police party, causing death to some police personnel and petitioner is named in the FIR and further petitioner is accused in 12 other cases.

Submission of learned counsel for the petitioner is that there is no progress in trial and the case is still pending for appearance and petitioner is in custody since 31.1.2017 in this case.

Having heard both sides and in view of allegation, I

Patna High Court CR. MISC. No.18546 of 2019(3) dt.11-04-2019 2/2 am not inclined to grant bail to the petitioner. However, learned court below is directed to take steps for appearance of the accused persons and at the same time the Sr.Superintendent of Police, Gaya is directed to execute the warrant issued against the absconding accused persons. Further, learned trial court is directed to expedite the trial. With the above observation, this application is dismissed.
