Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 341, 323, 354, 504 and 506 of the Indian Penal Code, registered in connection with

Patna High Court CR. MISC. No.8312 of 2022(2) dt.01-09-2022 2/2 Dinara P.S.Case No. 42 of 2021.

As per allegation, initially the petitioners were granted regular bail by the court below but after addition of Section 307 of the IPC, they filed a petition for anticipatory bail apprehending their arrest. The learned court below has rightly held that the anticipatory bail petition is not maintainable. The learned court below is directed to dispose of the bail petition of the petitioners in the light of pronouncements of this Court as well as Hon'ble the Apex Court. With these observations, the application stands disposed of.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
