JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-11-2015 This is an application for grant of regular bail in favour of the petitioners who are accused in Kadirganj PS Case No. 21 of 2015 for the alleged offences punishable under Sections 364, 511, 384/34 of the Indian Penal Code.

Learned Senior Advocate appearing on behalf of the petitioners submits that civil dispute between the parties is the reason behind the institution of the present false case. He contends that the petitioners are the nephews of the informant and other coaccused persons are full brothers of the informant. He further submits that out of the said civil dispute, the informant has got instituted several cases against these petitioners and others. I find substance in the submission made on behalf

Patna High Court Cr.Misc. No.47542 of 2015 (2) dt.02-11-2015 2/2 of the petitioners that civil dispute between the parties is the reason behind the occurrence and accusation against these petitioners.

Considering the submission as above, this application is allowed.

Let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Shri C M Kumar, Judicial Magistrate, Masaurhi, District Patna in Kadirganj PS Case No.21 of 2015.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
