JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in Bidupur PS Case No. 241 of 2015 for the alleged offence punishable under Section 302 of the Indian Penal Code.

As per the prosecution case, the petitioner had assaulted the deceased with fist and slap and in course of altercation, the deceased fell on the road resulting into certain injuries on his person whereafter he died. The occurrence is said to have taken place because the petitioner had grievance that his daughter had been killed by the deceased. The family members of the deceased are accused in Bidupur PS Case No. 181 of 2015 registered on 13.4.2015. This case has been registered on 3.6.2015.

Considering the circumstances under which the

Patna High Court Cr.Misc. No.47604 of 2015 (2) dt.02-11-2015 2/2 occurrence had taken place and the fact that the petitioner has no criminal antecedent, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Bidupur PS Case No.241 of 2015.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
