2. The petitioner seeks bail in a case registered for offence under Sections 302, 201/34 of the Indian Penal Code.
3. It is alleged that this petitioner alongwith other coaccused persons abducted husband of the informant and later on, dead-body of husband of informant was found. Informant suspects that all the accused persons named in the F.I.R. including petitioner killed her husband.
4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence and only suspicion has been raised against petitioner and other coaccused persons. Two co-accused namely Md. Saif Ali and
Patna High Court CR. MISC. No.8980 of 2025(2) dt.17-03-2025 2/2 Sawed Ali, having similar and identical allegation, have already been granted bail by a coordinate Bench of this Court, vide order dated 30.01.2024 passed in Cr.Misc. No. 39477 of 2023 (Annexure P/5). Petitioner has got clean antecedent and is in custody since 28.10.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Town (Sarai) P.S. Case No. 682 of 2022.
