JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Sahpur P.S. Case No. 45 of 2015, disclosing offences under Section 379 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that he was not named in the First Information Report. The stolen motorcycle along with other stolen motorcycles were recovered from the possession of one Bikash Sharma on the basis of whose confessional statement, the petitioner has been made accused and has been taken into custody. He is in custody since 28.07.2015. He submits that neither any recovery has been made

Patna High Court Cr.Misc. No.47599 of 2015 (2) dt.04-11-2015 from the petitioner's possession nor he has been put on Test Identification Parade so far. He has also submitted that the said Bikash Sharma has been granted regular bail by this Court vide order dated 01.10.2015 passed in Cr. Misc. No. 45707 of 2015. In view of the submissions as above, this application is allowed. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara in Sahpur P.S. Case No. 45 of 2015.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
